00:00:05( grunting )
00:00:11( muted screaming )
00:00:32( muted, distorted alarm ringing )
00:00:36( gasps )
00:00:47You all right?
00:00:49What time is it?
00:00:510400.
00:00:53Your hearing starts in four hours.
00:00:54I suggest trying to get some sleep.
00:00:56You've got a big day ahead of you.
00:03:00( dings )
00:03:03This hearing will come to order.
00:03:06We are here to consider the request of the Klingon Empire that Lieutenant Commander Worf be extradited for trial on charges of murder.
00:03:13Advocate Ch'Pok.
00:03:15You may present your charges.
00:03:17The Klingon Empire makes the following allegations against Lieutenant Commander Worf:
00:03:22That on stardate 49648 while commanding the Starship Defiant he knowingly fired upon and destroyed a Klingon civilian transport ship near the Pentath system.
00:03:35That as a result of that action
00:03:37441 Klingon civilians were killed.
00:03:40It is my intention to prove that Mr. Worf was grossly negligent in his command of the Defiant.
00:03:47That his lust for combat overrode his good judgment.
00:03:53I ask only that he be returned to us to face the judgment of his own people.
00:04:02Thank you.
00:04:08The Advocate neglected to mention in his opening statement that at the time in question the Defiant was under attack by two Klingon warships.
00:04:18This was a combat situation with hundreds of lives at stake.
00:04:21It was at that moment, when suddenly the transport ship de-cloaked in front of the Defiant.
00:04:27Worf gave the order to fire.
00:04:28Not because he was reckless or negligent but because he believed he was firing on a warship.
00:04:35We intend to show that the destruction of the transport was a tragic but unavoidable accident.
00:04:45I will hear formal evidence beginning tomorrow afternoon at 1500 hours.
00:04:56I want to know everything there is to know about the Klingon who was commanding that transport ship.
00:05:01You suspect it wasn't just an innocent passenger run.
00:05:03I'm going to argue that he saw the battle and then decided to join it that he de-cloaked in order to attack the Defiant.
00:05:10Not the smartest decision he ever made.
00:05:12That's where you come in.
00:05:14Use your contacts in the Empire and find out something about this Captain I can use.
00:05:18Was he reckless?
00:05:19Did he have a reputation for drinking?
00:05:21Did he have a death wish? Something.
00:05:23I'll see what I can do.
00:05:27CH'POK: Captain.
00:05:31The witnesses I intend to call.
00:05:33Thank you.
00:05:36A remarkable station, Captain.
00:05:38Thank you.
00:05:40We don't get many Klingon visitors anymore.
00:05:42After this case is over you might be seeing a lot more of us.
00:05:45Oh?
00:05:47When Worf is extradited the Federation will be forced to admit that one of its officers committed a massacre.
00:05:53That will put you on the defensive throughout the Quadrant.
00:05:56And while you're busy trying to repair a badly damaged reputation we'll find ourselves with certain... opportunities.
00:06:06An opportunity to annex more Cardassian space and set up additional military bases in this sector?
00:06:13Possibly.
00:06:14But in any case, Worf is about to present us with something we never could have won in battle.
00:06:20Sympathy.
00:06:22Any move we make against you will be seen as a legitimate response to an outrageous slaughter.
00:06:28You're presuming an awful lot.
00:06:30Worf maintains his innocence.
00:06:32And you're about to remind me that the burden of proof is mine.
00:06:37It's an interesting system of justice you have, Captain.
00:06:41It does have its flaws, however.
00:06:43It emphasizes procedure over substance form over fact.
00:06:50I'm sorry if you feel it puts you at a disadvantage.
00:06:53On the contrary.
00:06:54I look forward to fighting on your terms.
00:06:57This is not a fight.
00:06:58It's the search for the truth.
00:07:02The truth must be won.
00:07:05I'll see you on the battlefield.
00:07:15I have studied Commander Worf's reports the Defiant's sensor logs and the reports of the other officers on the Bridge.
00:07:22And I believe every word of it.
00:07:25It's a matter of pride for the Federation that Starfleet officers never lie or commit fraud.
00:07:31So I will accept the facts of the case as they have been submitted.
00:07:36Admiral, if there are no facts in dispute, then this hearing would appear to be at an end.
00:07:44We Klingons are not concerned with matters of fact and circumstance.
00:07:49What matters to us is what was in Worf's heart when he gave the order to fire.
00:07:53Was he just a Starfleet officer doing his duty, or was he a Klingon warrior reveling in the battle?
00:07:59That is why I am here.
00:08:01Because if he was a Klingon lost in the bloodlust of combat, only we can judge him, not you.
00:08:11We can't put a man's heart on trial.
00:08:14It's a subjective issue that cannot be reasoned in a court of law.
00:08:17I ask that the Advocate be limited to arguing the evidence in this case.
00:08:23Someone told me this was a search for the truth.
00:08:25Should we not follow that search wherever it takes us?
00:08:29The question of Commander Worf's motive is relevant.
00:08:34I will allow you to explore this issue but only as far as logic permits.
00:08:41I bow to your judgment.
00:08:43You may call your first witness.
00:08:47CH'POK: You are considered something of an expert on Klingon society, aren't you, Commander?
00:08:52My previous host, Curzon, would have called himself an expert.
00:08:56I tend to think of myself as having a passing familiarity with your culture.
00:09:00In your opinion, as someone with a...
00:09:04passing familiarity with our culture wouldn't you say the Klingons are a violent, warrior race?
00:09:11Yes, there is that aspect to your people.
00:09:14Would you agree that one of the things that makes a Klingon warrior so formidable is his predatory instinct, his blood lust, if you will?
00:09:23I'd agree with that.
00:09:25Now, when Worf was on the Defiant engaged in combat, don't you think his predatory instinct took over?
00:09:33I think that instinct was present but I've seen Mr. Worf restrain it before.
00:09:37How do you know so much about how he behaves in battle?
00:09:40In the holosuite, we've fought many times.
00:09:43You mean you practiced with Mr. Worf.
00:09:46You played with him.
00:09:48Oh, no.
00:09:50When we fight, we fight.
00:09:52I've made it very clear to Mr. Worf
00:09:55that I never want him to take it easy on me
00:09:58because I'm a woman or a Trill.
00:10:00Have you ever been injured?
00:10:02A few bruises here and there.
00:10:04A broken finger once.
00:10:06Nothing serious, and I've given him a few lumps of his own.
00:10:12CH'POK: So you're not afraid of Mr. Worf.
00:10:15I'm no fool.
00:10:17I can see the killer instinct in his eyes.
00:10:19And I know he could kill me if he wants to.
00:10:22But that look always goes away.
00:10:25He knows when to stop.
00:10:27Jadt.
00:10:29Admiral, at this time
00:10:30I would like to enter into evidence files I obtained from the defendant's private data base this morning.
00:10:35SISKO: Objection.
00:10:37There's been no search order issued for those files.
00:10:40This is a violation of Mr. Worf's privacy.
00:10:42The Captain is correct.
00:10:44Without a properly executed search order or the permission of the defendant, any information you have accessed from his private data base may not be admitted into evidence.
00:10:54Ah. I see.
00:10:55Well, I obviously have no search order so I'll ask you, Worf.
00:11:01May I enter this file into evidence or do you have something to hide?
00:11:06( whispers ): Don't play his game.
00:11:08I have nothing to hide.
00:11:11Use whatever you wish.
00:11:15CH'POK: Commander Dax, are you familiar with the holosuite program known as "The Battle of Tong Vey"?
00:11:21Yes. It's one of the programs
00:11:23Mr. Worf brought with him from the Enterprise.
00:11:26Describe it for us.
00:11:28It's an historical reenactment of one of the epic Klingon battles.
00:11:3210,000 warriors under the command of Emperor Sompek conquer the city of Tong Vey after a long siege.
00:11:40A glorious battle.
00:11:42When Worf recreates it in the holosuite what role does he play?
00:11:48Sompek.
00:11:50Of course. The conqueror's role.
00:11:52One of our greatest heroes.
00:11:54Tell me, Commander.
00:11:57What was the final order Sompek gave to his men once they had conquered the city of Tong Vey?
00:12:10Commander?
00:12:14He told them to burn the city to the ground and kill everyone in it.
00:12:18Everyone?
00:12:20Not just the soldiers, but the people of the town, too?
00:12:27Civilians?
00:12:29Women?
00:12:31Children?
00:12:33Yes.
00:12:35CH'POK: Now, Commander when Mr. Worf runs this program, does he give the final order to destroy the city and kill all of the inhabitants?
00:12:48It's not the same thing.
00:12:50It's a simulation...
00:12:52Answer the question.
00:12:59That's the way the program is supposed to end.
00:13:01You have to give that command...
00:13:03Admiral
00:13:04I ask that the witness be instructed to answer the question "yes" or "no."
00:13:08Yes or no, Commander.
00:13:15Yes.
00:13:16CH'POK: Of course he does.
00:13:18Because he is a Klingon warrior.
00:13:20He doesn't have the same moral code as a Starfleet officer.
00:13:23He is one of us-- a killer, a predator among sheep.
00:13:27Objection!
00:13:29Restrain yourself, Advocate.
00:13:35I have only one more question for this witness
00:13:38Admiral.
00:13:41Commander Dax when was the last time Worf used that program?
00:13:54( padd beeping )
00:13:58The day before he left on the convoy mission.
00:14:06The day before.
00:14:09The day before.
00:14:14I have nothing further.
00:14:29Captain, you ordered Worf to command the Defiant on the mission in question, did you not?
00:14:35That's right.
00:14:40How did you describe the mission to Worf?
00:14:42An outbreak of Rudellian plague has struck the Cardassian colony on Pentath III.
00:14:47The Cardassians are preparing several convoys of medical supplies and relief workers but the Pentath system borders Klingon territory and the Cardassians are worried about raids.
00:14:59Well, Pentath is a strategically important system.
00:15:02The Klingons will try to stop them.
00:15:05The problem is the Cardassians don't have enough warships available to protect the relief convoy.
00:15:10They've asked for Starfleet protection and because of the humanitarian nature of the request we've agreed.
00:15:17There will be seven convoys headed for Pentath III in the next week.
00:15:23Each of them protected by a Federation starship.
00:15:25The Defiant has been assigned to escort convoy six and I've chosen you to be in command.
00:15:30CH'POK: Why did you select Worf for this mission?
00:15:35I felt that he was an experienced officer who was ready to take on greater responsibilities.
00:15:43He had a distinguished record and obviously understood the Klingons.
00:15:47Weren't you a little worried, Captain, that Worf-- a famed Klingon warrior-- might jump at the chance for combat and forget about the plague victims?
00:15:57If I were, I wouldn't have given him the assignment.
00:16:00And you're sure you made your instructions perfectly clear-- that Commander Worf knew he was on a humanitarian relief mission that he was not being sent out to seek combat?
00:16:11Yes.
00:16:13Thank you, Captain.
00:16:14I have nothing further for you.
00:16:17Captain, since you are also acting as defense counsel if you wish to add anything to the record you're free to do so.
00:16:25Not at this time, Admiral.
00:16:27Call your next witness.
00:16:29It was about 1700 hours.
00:16:32I was doing some cleanup work.
00:16:34Dr. Bashir was at the bar talking to Etheria one of the dabo girls.
00:16:39Have you ever seen the wormhole open?
00:16:42No, wait.
00:16:43It wasn't Etheria; it was Glidia.
00:16:45Have you ever seen the wormhole open?
00:16:49Or was it... Midia?
00:16:54CH'POK: Mr. Quark, is this necess...?
00:16:56No, no. No, it was Ralidia, and she was with Morn and he was the one who turned to her and said...
00:17:04Can we get back to the matter at hand, please?
00:17:08Oh, right.
00:17:10Um... well, as I said
00:17:12I was cleaning up, and I saw Mr. Worf come in.
00:17:14CH'POK: Was there anything unusual about that?
00:17:18No. He comes in here all the time.
00:17:21But he was in a good mood.
00:17:24And that's unusual?
00:17:26Well, he's a Klingon and you people are rarely in what I would call good moods.
00:17:31Not that you're anything but a pleasant, charming race.
00:17:37Let's get back to Mr. Worf.
00:17:39Describe what happened next.
00:17:41He came in, he ordered a drink-- prune juice, I believe-- and we started to talk.
00:17:48I'd heard about the convoy mission so I asked him about it and he said he was going to be commanding the Defiant.
00:17:56What was his attitude?
00:18:00Hard to say.
00:18:01He's a very private man.
00:18:05He doesn't share a lot with his bartender.
00:18:08Did he seem... afraid of the mission?
00:18:12No.
00:18:14Did he seem excited by the mission?
00:18:16Not excited exactly.
00:18:19Then what exactly?
00:18:22I just remember asking him...
00:18:24What happens if the Klingons go after the convoy?
00:18:28And then he got this funny look on his face.
00:18:31He put down his prune juice looked me right in the eye, and then he said...
00:18:37I hope they do.
00:18:39"I hope they do."
00:18:41Well, it would appear
00:18:44Commander Worf's hopes were answered.
00:18:46I have nothing further.
00:18:57What do you have for me, Constable?
00:18:59Background on the Klingon transport captain.
00:19:01He'd never been in the military and he was known to his family and friends as a quiet, efficient man who was content in his position.
00:19:08Doesn't sound like a man who'd suddenly decide to take on the Defiant.
00:19:12No.
00:19:14What about this story of theirs that the transport ship just wandered off course into a combat area?
00:19:20I checked the flight plan the Captain filed and the projected course was near the border.
00:19:25It would have taken only a very slight error in navigation for the ship to stray into the fight.
00:19:31But why did he drop his cloak right in front of the Defiant?
00:19:34Ah, that's the question no one seems able to answer.
00:19:37No one seems able, or no one seems willing?
00:19:41Oh, they're too willing to answer questions-- that's the problem.
00:19:45I'm always suspicious of people who are eager to help a police officer.
00:19:49Start looking into the passengers on that ship.
00:19:52Maybe someone with a grudge against Worf or the Federation was aboard-- someone who could have seized control of the ship and taken it into the battle.
00:20:00I'm reaching, I know.
00:20:03But at the moment, it's all we have.
00:20:05I'll keep looking.
00:20:08There were two Klingon ships-- a bird-of-prey and an old battle cruiser.
00:20:11One would engage us while the other went after the convoy.
00:20:14Then they'd switch.
00:20:15The first ship going after the Cardassians while the second ship came after us.
00:20:24We've lost the number three starboard shield.
00:20:26Come about.
00:20:28The cruiser has taken us too far away from the convoy.
00:20:30Try to keep our port side to the Klingons.
00:20:32Aye, sir.
00:20:34This went on for-- I don't know, maybe five minutes.
00:20:38They'd come at us, try to draw us away from the Cardassians.
00:20:40We'd head back.
00:20:41Then the bird-of-prey came toward us off the port bow.
00:20:48I have phaser lock.
00:20:49Fire.
00:20:54We damaged them but not much.
00:20:57We'd seen them do this cloak- and-run maneuver a few times and Commander Worf thought he saw a pattern.
00:21:02We have them now.
00:21:04Come to course 185 mark 278.
00:21:06Stand by quantum torpedoes, full spread.
00:21:09Aye, sir.
00:21:10I ran a quick sensor sweep then I reported.
00:21:13I'm picking up a tachyon surge directly ahead.
00:21:15Fire.
00:21:20SISKO: When did you realize it wasn't a bird-of-prey?
00:21:24As soon as it exploded.
00:21:26Oh, my God.
00:21:27We were all stunned.
00:21:29I scanned for survivors, but there were none.
00:21:31Chief, do you believe
00:21:34Worf was correct in giving the order to fire?
00:21:36I stand by his decision.
00:21:38Is there any question in your mind about his motives?
00:21:42No, sir.
00:21:43I've known Commander Worf for nine years.
00:21:46He's an honorable man.
00:21:48He would never intentionally fire on an unarmed ship.
00:21:51Thank you, Chief.
00:21:57I'm curious, Chief.
00:22:00You say you stand by Commander Worf's decision.
00:22:04Do you agree with it?
00:22:05I completely support him.
00:22:08That's not my question.
00:22:10Do you agree with his decision?
00:22:13I wasn't in command.
00:22:15It's not my place to question his judgment.
00:22:18What if you were in command?
00:22:20What would you have done?
00:22:23I don't know.
00:22:25Chief, how many years have you been in Starfleet?
00:22:30Twenty-two.
00:22:31And how many combat situations have you been in?
00:22:34I couldn't even guess.
00:22:37Try.
00:22:40100, 150.
00:22:41For the record
00:22:43Chief O'Brien has been in 235 separate engagements and Starfleet has decorated him 15 times.
00:22:50I would like to have him declared an expert in the area of starship combat.
00:22:55Any objection?
00:22:57None.
00:22:59Chief O'Brien, if Mr. Worf had been injured could you have taken over command of that ship?
00:23:07I would have.
00:23:09Let's say that happened.
00:23:11You're in command.
00:23:13You're chasing the bird-of-prey.
00:23:16It cloaks.
00:23:17You anticipate your opponent's maneuver
00:23:19so you give the order.
00:23:21Come about to 185 mark 278.
00:23:23Stand by quantum torpedoes, full spread.
00:23:27CH'POK: The crew obeys.
00:23:28The ship comes about.
00:23:30And then your helm officer tells you...
00:23:32I'm picking up a tachyon surge, directly ahead.
00:23:35Now, stop right there.
00:23:36Freeze that moment in time.
00:23:38Everything rides on your next decision.
00:23:41Do you give the order to fire?
00:23:43This isn't a fair question.
00:23:45It didn't really happen this way.
00:23:47I wasn't in command.
00:23:49CH'POK: I'm not interested in whether you think
00:23:51it's a fair question or not.
00:23:52You're in command.
00:23:54There's a ship out there de-cloaking.
00:23:55You don't know what it is.
00:23:57Do you fire?
00:24:07No.
00:24:10But that's just my opinion now, after the fact.
00:24:13I wasn't in command that day.
00:24:16Things look a lot different when you're sitting in that chair.
00:24:25I'm sure they do.
00:24:47Captain Sisko mind if I sit down?
00:25:02I understand you're going to put Worf on the stand this afternoon.
00:25:06That's right.
00:25:07May I make a suggestion?
00:25:11Concede.
00:25:13Let me take him back to the Empire and I'll make sure he's not put to death.
00:25:17In fact, I'll defend him myself.
00:25:20You?
00:25:21What matters to me is the thrill of the fight, not which side I'm on.
00:25:26And I think we both know the extradition fight is over.
00:25:30You're not making this offer out of kindness.
00:25:33You want the Federation to concede so the convoys will stop and the Klingons can move in on the Pentath system.
00:25:42As humans would say, that would be icing on the cake.
00:25:48I wouldn't try eating that cake just yet, if I were you.
00:25:55But you have told me one thing I needed to know-- you're worried about what Worf might say on the stand.
00:26:05I'm not worried-- but you should be.
00:26:25ODO: Captain.
00:26:31Good news or bad?
00:26:33Bad. I checked the backgrounds of every passenger on that transport.
00:26:38None had any connection with Worf or grudge against the Federation or any motive for seizing control of the ship and attacking the Defiant.
00:26:47But I'm still not giving up.
00:26:49I appreciate that but I get the feeling that at this point the only one who can help Worf is Worf.
00:27:07The escort mission had proceeded smoothly for two days.
00:27:10We detected several subspace distortions which might have been cloaked ships but nothing definite.
00:27:16SISKO: So, what was the first sign of trouble, Mr. Worf?
00:27:18( alarm blaring )
00:27:20There was no warning.
00:27:23A bird-of-prey just de-cloaked off the port quarter.
00:27:26Raise shields. Arm phasers.
00:27:28Commander, another ship's de-cloaking.
00:27:31It's an older battle cruiser.
00:27:32She's going after the convoy.
00:27:35Bring us about.
00:27:38SISKO: How did you feel when the Klingons attacked?
00:27:40Were you excited?
00:27:43Of course.
00:27:44I am a Klingon.
00:27:45We live for battle.
00:27:47So that's all that mattered to you-- the chance to fight?
00:27:50No, sir. Whatever my personal feelings may be
00:27:54I do not allow them to interfere with my duty or my professional judgment.
00:27:59Chief O'Brien says that he disagrees with your decision to fire.
00:28:03How do you respond to that?
00:28:05I respect the Chief's opinion.
00:28:07He and I have served together for many years and I consider him a friend.
00:28:11However, he was not in command that day.
00:28:14What difference does that make?
00:28:16It makes all the difference.
00:28:18He is looking back at a decision analyzing it weeks later.
00:28:22As the Commanding Officer of the Defiant it was my duty to look forward to anticipate every possible situation.
00:28:28Did you anticipate encountering a civilian ship on this mission?
00:28:33I knew our convoy would be passing through civilian shipping lanes, but... in my judgment, the chances of a civilian vessel de-cloaking in the middle of a battle were remote.
00:28:44I decided that if I were engaged in combat
00:28:47I would not hesitate to fire at a de-cloaking ship.
00:28:50Mr. Worf, I want you to think about the civilians who died on that transport ship and answer one question.
00:28:59Under the same set of circumstances would you do it again?
00:29:07Yes, sir.
00:29:08If I had hesitated, I would have been negligent.
00:29:11I would have been risking my ship, my crew and the entire convoy.
00:29:18Thank you.
00:29:23Worf... why are you considered an outcast among Klingons?
00:29:29I sided with the Federation during the invasion of Cardassia.
00:29:33For that, Chancellor Gowron stripped me of my name and my family honor.
00:29:38So you acted out of conscience and you were punished for it.
00:29:41How do you feel about that?
00:29:44Angry? Bitter?
00:29:46I am angry about the treatment I have received.
00:29:50I felt it was unjust.
00:29:52Of course you are. Who wouldn't be?
00:29:55What happened affected your entire family.
00:29:58The House of Mogh was brought down.
00:30:01Your brother was ejected from the High Council in disgrace your lands seized and now your son, Alexander, has to bear the stigma of being the son of a traitor.
00:30:12Did I miss anything?
00:30:15No.
00:30:17In your opinion what do they think of you in the Empire, Worf?
00:30:20I am hated.
00:30:22Why? Because of what you did?
00:30:24Yes.
00:30:26Are you sure it's not something more basic?
00:30:29What is that supposed to mean?
00:30:33Isn't it obvious?
00:30:37You were raised by humans on Earth and now you wear their uniform.
00:30:44Haven't you really always been a traitor in your heart?
00:30:49No.
00:30:50Are you telling us that you live with humans, but your heart is Klingon?
00:30:54Yes.
00:30:56But if your heart is Klingon, how could you fire upon your own people?
00:31:00They fired the first shot.
00:31:02And when that happened, they became my enemies.
00:31:05Then why aren't you glad you destroyed that transport?
00:31:08It was filled with your enemies and their children.
00:31:10There is nothing honorable about killing those who cannot defend themselves.
00:31:15Are you telling me that you would never attack a defenseless opponent?
00:31:23No. I would not.
00:31:31Maybe I was wrong about you.
00:31:33Maybe you aren't really Klingon in your heart.
00:31:38A true Klingon rejoices at the death of his enemies-- old, young, armed, unarmed.
00:31:44All that matters is the victory.
00:31:47Tell me, Worf-- did you weep for those children?
00:31:55I grieve for them.
00:31:57Grieve for them?
00:31:58A Klingon does not grieve.
00:32:00They died in glorious battle.
00:32:03They are with the honored dead in Sto-Vo-Kor.
00:32:05They do not want your grief. You dishonor their memoryies!
00:32:08Objection!
00:32:09Advocate.
00:32:11WORF: You will say anything.
00:32:12You have no honor.
00:32:14I say this-- you live with humans because you're afraid to live with Klingons.
00:32:19I fear nothing and if you would like to pick up a bat'leth and face me with weapons instead of words
00:32:25I will prove it to you.
00:32:26You'd like that, wouldn't you, Worf?
00:32:28You'd love to prove that you are as strong and courageous as any Klingon warrior.
00:32:32I am a Klingon warrior.
00:32:34Advocate, you are stepping well beyond the bounds of protocol.
00:32:38And that is why you told the Ferengi you hope the Klingons do come for you.
00:32:41You wanted to prove yourself in the eyes of the only people that matter to you-- other Klingons!
00:32:47This will stop, or I will hold both of you in contempt.
00:32:53I apologize, Worf.
00:32:58Actually...
00:33:00I pity you.
00:33:02But the person I pity most is Alexander-- because one day he will come to you and ask
00:33:10"Father, who am I?"
00:33:13And you will have to tell him that he is the son of a small, frightened man who destroyed a ship full of children just to prove his own courage.
00:33:24Worf, no!
00:33:37I thought you told me you'd never attack an unarmed man.
00:33:46Perhaps you should have said
00:33:49"not unless I get angry."
00:33:54"Not unless I have something to prove."
00:33:58I rest my case.
00:34:16Captain's Log, Stardate 49665.3.
00:34:21The hearing is in recess and Admiral T'Lara
00:34:23has retired to her quarters to begin deliberations.
00:34:27I wish I could be more optimistic about her decision.
00:34:30( door opens )
00:34:31Constable.
00:34:34Good news.
00:34:37Don't worry. If he objects, I know what to do.
00:34:50( dings )
00:35:00Captain Sisko.
00:35:02Admiral, I apologize for interrupting your deliberations but I have some new evidence
00:35:08I'd like to present.
00:35:10Very well.
00:35:12I'd like Advocate Ch'Pok to evaluate the evidence as an expert witness on the Klingon Empire.
00:35:19I will not compel you to testify, Advocate.
00:35:28Care to step onto my battlefield?
00:35:41Advocate, how would you describe the current relationship between the Federation and the Klingon Empire?
00:35:48There is no formal relationship between our two governments.
00:35:53What would you call us?
00:35:55Informal friends? Informal enemies?
00:35:58I would say there is potential for either label.
00:36:02But at the moment, neither is entirely accurate.
00:36:05Hmm, interesting.
00:36:07Would you agree that, at the moment it is difficult for us to trust each other?
00:36:12Difficult, but not impossible.
00:36:14There are things that transcend our differences.
00:36:18For example, we trust that this case can be decided fairly.
00:36:22We have faith in Admiral T'Lara's judgment.
00:36:26Oh, I'm glad to hear you have such a profound respect for the Admiral.
00:36:32But would it be fair to say that outside this hearing you do not entirely trust us?
00:36:40Well, it is only prudent that we question your motives now that we are no longer allies.
00:36:48Of course, and it is only prudent of us to question your motives.
00:36:52After all, aren't there times when you feel it's in your best interest to deceive us?
00:36:58I object to the question.
00:37:01It is vague and hypothetical.
00:37:03Well, can you imagine any circumstance in which the Empire would deceive the Federation?
00:37:10I have a poor imagination.
00:37:12Let's see what we can do to spark it.
00:37:17Do you recognize these names?
00:37:23These are the people who were killed on board the transport.
00:37:26You're positive?
00:37:28There are 441 of them.
00:37:31The names and faces of these people are seared into my heart.
00:37:36This is a list of heroes who died at the hands of a coward.
00:37:41It is a list I can never forget.
00:37:44They are an interesting group of people, aren't they?
00:37:48From every walk of life-- merchants, soldiers, artists, shopkeepers...
00:37:54Children.
00:37:56Children.
00:37:58We've done some checking in their backgrounds and in our opinion they all appear to be a random group of people who shared only one thing in common:
00:38:08They all traveled on the same ship.
00:38:12Is that your conclusion as well?
00:38:14Yes.
00:38:15And it was just fate that led these particular people to board a doomed ship?
00:38:22Fate is a human concept.
00:38:26They simply boarded the wrong ship at the wrong time.
00:38:31And then... they did it again.
00:38:35I don't, uh... think I understand your line of...
00:38:40Three months ago a Klingon transport ship crashed in the mountains of Galorda Prime.
00:38:46Of course, everyone assumed the worst-- that the passengers and the crew had all been killed.
00:38:51But then, miraculously... everyone survived.
00:38:57Do you know anyone who was on that ship?
00:39:02No.
00:39:03Are you sure?
00:39:05You have the names of the survivors right there.
00:39:11I can understand your confusion.
00:39:15The names in front of you are identical to the names on this list.
00:39:21The people who were killed in the Defiant incident.
00:39:25So what does this mean?
00:39:30441 people somehow survived a crash on Galorda Prime.
00:39:36And then a few weeks later they all decide to take another trip on the same day on the same transport ship, under the same Captain and crew.
00:39:47And then that ship is destroyed, too.
00:39:49This is a very unlucky group of people, wouldn't you say?
00:39:54I am not an expert on luck.
00:39:59No. You are an expert on the Klingon Empire.
00:40:03So, tell me, Advocate isn't it possible that there were no civilians on the transport Worf destroyed?
00:40:12Isn't it possible that the ship he saw was sending out false sensor images and that this whole affair was staged so that the only Klingon officer in Starfleet would be accused of a massacre and the Federation would be forced to stop escorting the convoys?
00:40:30Tell me, Advocate... isn't it possible?
00:40:44Yes.
00:41:03Captain.
00:41:05I thought you should know
00:41:07O'Brien and Bashir are throwing a party for you at Quark's.
00:41:10Looks like quite a bash.
00:41:12I am aware of it.
00:41:14But I have much on my mind.
00:41:17Ch'Pok was right.
00:41:18I did have something to prove when I took command of the convoy.
00:41:23And I did not realize it until I stood there, looking down at him blood trickling from his mouth.
00:41:32In that moment, I remember thinking finally, he had given me what I really wanted-- a reason to attack him.
00:41:41And I had that same feeling when the Klingon ships first attacked.
00:41:46Finally, a chance for vengeance.
00:41:53I should not have accepted the mission.
00:41:55I am glad you realize that.
00:42:03That was your first mistake.
00:42:06What was your second?
00:42:10When the ship de-cloaked
00:42:12I should have checked the target before I fired.
00:42:14You're damned right you should have checked.
00:42:16You knew there were civilian ships in the area.
00:42:18You fired at something you hadn't identified.
00:42:25You made a military decision to protect your ship and crew.
00:42:30But you're a Starfleet officer, Worf.
00:42:33We don't put civilians at risk, or even potentially at risk to save ourselves.
00:42:39Sometimes that means we lose the battle and sometimes our lives.
00:42:43But if you can't make that choice then you can't wear that uniform.
00:42:50Yes, sir.
00:42:52At ease, Commander.
00:42:58Now, all that being true the reality is no harm's been done.
00:43:04There are no dead children on your conscience.
00:43:08You got lucky.
00:43:11I do not feel lucky.
00:43:14And that's why, despite everything that's happened you're going to make a hell of a Captain someday.
00:43:20Now, let's go.
00:43:22They'll all be waiting.
00:43:23( sighs )
00:43:26Look, this party isn't for you as much as it is for them.
00:43:31Things got a little tense there for a while.
00:43:34They need a release, a chance to celebrate.
00:43:37But I do not feel like celebrating.
00:43:40Part of being a Captain is knowing when to smile.
00:43:44Make the troops happy-- even when it's the last thing in the world you want to do.
00:43:49Because they're your troops and you have to take care of them.
00:43:56Life is a great deal more complicated in this red uniform.
00:44:00Wait till you get four pips on that collar.
00:44:03You'll wish you had gone into botany.
